Use of the Website
Use of this website is subject to these Terms and Conditions and our Privacy Policy. Please read the Terms carefully and refrain from accessing the Website or from using any service offered thereon if you disagree with any of the Terms. By accessing the site, you accept, without limitation or qualification, all the terms and conditions below.
LHV Role
LHV is not the owner of the rented properties, but only lets the properties and facilitate booking payment on behalf of the property owners. Any contract is between the owners of the property and the applicant. LHV do not accept liability for any act or neglect on the part of the owners or any other person not within their employ or their control, nor for any accident, damage, loss, injury or expense, whether to person or property, which the tenants may suffer arising out of, or in any way connected with the letting. The owner and the letting agent also accept no liability for loss of or damage to the tenants’ possessions on the owners’ property.
How to Book
In order for us to accept your booking your party leader must read the chosen villa terms and conditions. The person who submits the booking form does so on behalf of all the members of the party and binds them jointly to these terms and conditions. When you ask us to confirm your booking on the property you choose, you will receive a booking reservation details on what is included, rental price, villa policy and instructions for payment. Accordingly the property will be blocked for your reservation for a period agreed in order for the reservation deposit to be transferred. With the receipt of the reservation deposit the booking will be finalised and confirmed to you. If the reservation deposit is not received within the due date agreed, the booking will be cancelled.
All holiday homes are rented out on a ‘first come first serve’ basis.
Payment
A non-refundable deposit is required to make a booking. Between 20% to 50% non-refundable deposit is required depending on which villa you choose to book. Payment terms and conditions reflect directly to the property owner’s individual policies.
For bookings made less than 30 days or less prior to arrival, a full payment will be required within 3 business days after the booking is confirmed. If payments are not made on or before the due dates as required herein, LHV reserves the right to void the guest’s booking request without any notice.
For bookings made 7 days or less prior to arrival, a full payment will be required not later than 24 hours after the booking is confirmed. If payments are not made on or before the due dates as required herein, LHV reserves the right to void the guest’s booking request without any notice.
Security Deposit
All bookings are subject to a refundable security deposit. This is to cover the cost of any damage or breakage during the rental period of the villa or its surrounds or their contents caused during the rental period. If there are any damages where costs exceed the amount of the deposit, the guest will remain liable to pay the outstanding amount promptly to the villa manager or owner’s representative before checking out the property. Access to the Villas may be refused if security deposit is not paid in full. The security deposit will normally be refunded at the end of the rental period, after deducting all additional expenses incurred on the Guest’s behalf during guest’s stay or the cost of replacement or repair for any loss or damage to the Property.
Booking Cancellation
Any cancellation request will take effect from the day the written confirmation is received by LVH (email acceptable) from the guest. All cancellations made by the guest are subject to penalties. This policy directly reflects the property owners individual policies, and you should therefore take out suitable travel insurance to cover the risks that may lead to such an eventuality. Answers to any cancellation request or possible exceptions to cancellation policy penalties will be answered by individual property owners or owner’s representatives after receiving your cancellation request.
Booking Amendments
Booking amendments can only be accepted in accordance with the terms and conditions of the Owner of the Property. If you wish to amend your booking, whilst we will try to assist, we cannot guarantee that such requests will be available and if the original booking rate is the same on the new date request. The Owner may charge an amendment fee and in addition.
Arrival and Departure
Check-in time and check-out time are mentioned on the property description and on booking your confirmation. Early arrival or late departure will depend upon the availability of the Villa at the time of arrival or departure. An additional fee may be applicable and will be advised at the time of booking.
Registered Guests
Please note that over-occupancy of property is not allowed. Only the number of guests (adults, children and or infant/s) stipulated in the Rental Agreement may reside at the property as guests, unless prior written agreement has been made with property owners or owner’s representative. Registered guests cannot exceed the number of guests provided at the time of booking by the lessee. Should the villa owner or the owner’s representative find that the number of people staying at the property exceeds the number of registered guests, the property owner or the owner’s representative may, at his or her absolute discretion, ask the extra person or persons to either pay the applicable additional charge as per the published rate or to vacate the property forthwith.
Events, Weddings and Private Parties
In case an event, wedding or party is to be organized within the property for a number of guests in excess of the registered guests in the villa, this must be agreed prior to booking, as some villas have restrictions on the number of events permitted and the number of guests allowed. For an Event to be approved, full occupancy rates and minimum number of nights apply and the additional Event T&C have to be agreed upon. In addition, a refundable damage security deposit will be collected either by international bank transfer or on site in cash from which a cleaning surcharge, damages or breakages during the time of event, may be deducted before refunded to the Guests. A professional planner must be organized for all events, wedding and private parties by the guests as villa staff are not able to assist with planning. A plan for the event must be submitted to the Villa Concierge for approval at least 1 month prior to the date of the wedding or event.
Smoking
Smoking is not allowed inside the villas. Outdoors only. Smoking is a breach of the rentals contract and can lead to the cancellation of the booking with no compensation.
Pets
No pets are permitted in the villa or on the villa property.
Force Majeure
Luxury Home Villas cannot accept responsibility or pay compensation where the performance of our contractual obligations is prevented by or affected by events amounting to Force Majeure (Force Majeure meaning acts of war or threat of war, political unrest, terrorist activities, adverse weather conditions, volcanic ash clouds, strikes, acts of God, epidemics, riots, civil strife, industrial disputes, terrorist activity, natural or technical disasters, nuclear war) and or similar events out of our control.
Complaints
If there are any problems during the rental period, which could not be solved by dealing directly with the local villa staff, Guests can contact LHV or its local representative immediately and LHV will make best efforts to arrange for any such problems to be solved quickly. LHV or its local staff cannot be held liable for interruptions to the supply of water, electricity, Internet connection, cable TV, breakdown of lifts or swimming pool filtration systems, air-conditioning system or heating system. It is understood that infrastructure, local standards and conditions are often of a less developed nature in a remote resort location than in more urban environments. LHV will do as much as can be reasonably expected to avoid and rectify any problems that may occur, but cannot be held responsible for any problems beyond its control. Any complaints should be written and given to the LHV within 24 hours of the time the issue occurred. No complaint will be considered if made after the departure date or if not acknowledged by the villa owner, LHV or the local villa staff.
Conduct & Behavior
The person paying the villa rental deposit is responsible for the correct and appropriate behavior of the guests staying at the villa. Should any member of the party behave in a manner considered inappropriate, either LHV or the villa owner or local staff may at their absolute discretion ask the offending guest or guests to vacate the villa immediately, without compensation or refund.
Travel Insurance
Holiday and travel Insurance, including cancellation cover, is essential for your own protection and we strongly recommend that you and all members of your party be suitably insured. If you choose to travel without adequate holiday insurance cover, we will not be liable for any losses however arising in respect of which insurance cover would otherwise have been available.
